B000101 - COMPARATIVE AND EUROPEAN CONSTITUTIONAL LAW

The course will be held in Italian language.

This course deal with the origins and evolution of modern and contemporary constituionalism; with the notion of constitution in its various meanings; with the birth, the content, the application, the transformations and the revisions of constitutional arrangements as well as textual constitutions; finally with the debate around the limits o constitutional changes. Some specific constitutions will be studied (Uk, Usa, France, Germany, Switzerland and also the European Union). Particular attention will be devoted to the themes of the Italian political institutions, of its bicameral Parliament and of the attempts to revise them in the present parliamentary term, as well as to how the multilevel protection of rights is ensured.
The textbook is: Morbidelli e altri (Pegoraro, Reposo, Volpi), Diritto pubblico comparato, Giappichelli, Torino ultima edizione (2012). Students are also require to red and to report on a volume of "Si governano così" (Mulino, Bologna), a collection of books devoted to single countries. The course will focus on: constitutionalism, its origins and evolution; different notions of Constitution; creation, contents, enforcement and guarantees of contemporary constitutions; processes and limits to constitutional revision. Particular attention will be devoted to the analysis of the forms of State and the forms of government. The third modulo will consist on the analysis regarding the Italian Constitution and the perspectives of the Constitutional Reform.

Purpose of this course is to provide the basic knowledge of contemporary constitutionalism conceived as an instrument to regulate a polity and as instrument of dialogue and reciprocal guarantee within variably split societies. At the end of the course those who will have attended it fruitfully should be able to find all the sources and materials needed to discuss constitutional issues, they should master the elementary methodology to compare different constitutional experiences, and to autonomously evaluate italian constitutional issues, being able to express structured and informed opinions.

Some public law, if provided by the curriculum

The course includes about two thirds of lectures, which will include some dialogue and discussion between the students an the teacher; a series of conferences devoted to specific jurisdictions. An intermediate test is forseen aìin the form of an exercise.

Intermediate written test, draft of a short paper on one of the book freely selected, a final written test, active participation day by day.
